Koupely Terms of Use and Sale
By using Koupely, you agree to these terms. They explain how dynamic-price offers, orders, payments, refunds and deliveries work, along with your rights and responsibilities as a user.
Lire en français1. Purpose and scope
These Terms of Use and Sale (the "Terms") set out the rules that apply to accessing, using and transacting through the Koupely mobile app, the Koupely website and, more broadly, any digital service operated under the Koupely brand.
Koupely is a service that lets users discover commercial offers, take part in group-buying or dynamic-price mechanisms, place orders, make payments, track their orders, benefit where applicable from price reductions tied to how an offer evolves, and receive the corresponding refunds or financial adjustments.
These Terms govern in particular: • creating and using a Koupely account • browsing offers • taking part in dynamic-price offers • orders • payments • price-drop mechanisms • refunds • deliveries • relay points • order tracking • pickup codes or QR codes • notifications • delivery addresses • the use of location features • the relationship between Koupely and its users
Any use of Koupely constitutes acceptance of these Terms.
2. Identity of the operator
The Koupely platform and services are operated by:

DJEHI GROUP's activities include web and mobile development, building digital platforms, artificial intelligence and automation, digital communication and marketing, technology project management, IT systems consulting and e-commerce.
In these Terms, "Koupely", "we", "our" and "us" refer to the entity operating the Koupely service.
3. Accepting these Terms
Before creating an account, joining an offer or placing an order, users are invited to read these Terms.
By creating an account or using Koupely's services, the user acknowledges that they: • have read these Terms • have understood them • accept them without reservation • have the legal capacity needed to use the service and enter into a transaction
A user who does not accept these Terms must not use Koupely's transactional features.
4. Changes to these Terms
Koupely may amend these Terms, in particular to reflect changes to the service, new features, technical changes, new payment methods, new delivery arrangements, regulatory developments, security requirements or changes to how offers work.
The applicable version is the one available in the app at the time the service or the relevant transaction is used.
Where changes are significant, Koupely may inform users through a notification, an email, or a message shown in the app.
5. Creating a user account
Some features may require creating a personal account.
Users may be asked to provide, among other things: • their last name • their first name • their phone number • their email address • their delivery address • a password • information needed to fulfil an order
Depending on the features available, Koupely may also offer sign-in through a third-party provider such as Apple or Google.
Users undertake to provide accurate, complete and up-to-date information.
6. Account security
Users are responsible for keeping their credentials confidential.
Users must not: • share their password with anyone else • knowingly allow another person to use their account • circumvent security mechanisms • create an account using fraudulent information
If unauthorized access is suspected, the user must change their credentials and contact Koupely as soon as possible.
Koupely may require additional verification, including by OTP, SMS, email or any other security method.
7. Personal use of the account
Unless Koupely specifically authorizes otherwise, a user account is personal.
Koupely may limit, suspend or review an account in cases such as suspected fraud, abusive use, artificially multiplying accounts, circumventing an offer's limits, payment fraud, manipulating discount mechanisms, or using unauthorized automated tools.
8. How Koupely offers work
Koupely may offer several types of offers.
Some offers may rely on a mechanism under which the price of a product or service can fall as the number of participants increases.
Each offer may display, among other things: • a starting price • a current price • one or more price tiers • a current number of participants • a participant target • a next price • a potential saving • a duration • an available quantity • specific conditions
The information shown on the offer page is the applicable reference for that offer.
9. Entry price
When a user joins an offer at a given price, that price may be recorded as their "entry price" or reference price.
Example: price at purchase, 650,000 F CFA. If the offer later evolves and its final price becomes 620,000 F CFA, the resulting difference may give rise to a refund under the offer's rules. In this example, 30,000 F CFA may be owed to the user.
10. Price drop after purchase
The price-drop mechanism is a core feature of certain Koupely offers.
Where expressly provided for an offer, the applicable price may fall after a user has joined or bought the offer.
The amount owed to the user then corresponds, subject to the offer's own rules, to the difference between the price actually applied to their purchase and the final price set for the offer.
Koupely may display, in real time or close to it: • the entry price • the current price • the final price once the offer closes • the saving obtained • any amount owed as a refund
11. Prices cannot be raised retroactively
Where an offer benefits from Koupely's price-protection mechanism, a later increase in the offer's price must not retroactively increase the amount the user agreed to pay.
The exact terms applicable to an offer are shown before the order is confirmed.
12. Price tiers
An offer may include several price tiers.
Example: 10 buyers, 650,000 F CFA; 20 buyers, 620,000 F CFA; 30 buyers, 600,000 F CFA.
When a tier is reached, the offer's price may be adjusted automatically. The applicable tiers are those shown in Koupely.
13. Participant counter
Koupely may display the number of participants in an offer.
This number may change following new orders, cancellations, failed payments, fraud detection or technical corrections, among other things.
The final number of participants is the one validated by Koupely's system when the offer closes or is finally processed.
14. Countdown timer
Some offers are time-limited. A countdown timer may be displayed.
When the time runs out, Koupely may: • close the offer • stop accepting new participations • calculate the final price • start the order or refund process • exceptionally extend the offer where that possibility was clearly announced
15. Stock
Some offers have limited stock.
Adding a product to the ordering process does not necessarily guarantee it is definitively reserved until the conditions needed for confirmation are met.
Stock may be reduced, in particular, once payment or the order is confirmed.
16. Placing an order
To place an order, users may need to, among other things: • select an offer • choose a quantity • select a delivery method • select or enter an address • optionally choose a relay point • choose a payment method • review the order summary • confirm the transaction
An order is only considered definitively placed once confirmed by Koupely.
17. Summary before confirmation
Before final confirmation, Koupely shows the user the key information about the transaction, including the product or service, quantity, price, delivery fees, any applicable discounts, delivery method, total and payment method.
Users are responsible for checking this information before confirming.
18. Payment methods
Depending on the country, the offer and the providers available, Koupely may offer several payment methods, including Wave, Orange Money, MTN Money, Moov Money, Visa, Mastercard, and any other provider integrated later.
The availability of a given payment method may vary. Koupely may temporarily disable a payment method for technical, commercial, regulatory, security or maintenance reasons.
19. Payment processing
Some transactions are carried out by independent payment providers.
Depending on the payment method, a transaction may be subject to an immediate debit, an authorization, a delayed confirmation, a later capture, or a refund.
The exact method that applies must be communicated to the user before or during the payment process.
20. Payment failure
A payment may fail for reasons including insufficient balance, a declined transaction, a network interruption, an error at the payment provider, a validation timeout, or an authentication error.
In that case, Koupely may offer to retry, change the payment method, or return to the order.
A failed payment must not be treated as a confirmed payment.
21. Fees
Additional fees may apply, for example for delivery, certain services, certain payment methods, or certain geographic areas.
They must be shown before final confirmation.
22. "To receive"
Koupely may show a section in the user's account called "To receive".
This section reflects amounts that Koupely or a provider still owes the user under transactions already carried out.
It may include amounts arising from a drop in an offer's final price, a refund, or a commercial adjustment.
23. "To receive" is not an e-wallet
Unless a specifically regulated service is launched for this purpose in the future, the "To receive" section is not a bank account, is not a payment account, is not an e-wallet, does not constitute a deposit of funds, does not freely allow sending money to a third party, and is not a money-transfer instrument.
It is essentially a representation of the amount still owed or being returned.
24. Refunds
When a refund is owed, Koupely may display the product concerned, the order, the price paid, the final price, the amount to be refunded, the payment method, the refund status and the refund reference.
25. Refund statuses
A refund may appear, among other statuses, as:
"To receive": the amount has been identified as owed to the user.
"Processing": the refund procedure has been started.
"Refunded": the refund has been confirmed as completed.
"Failed": the refund could not be completed and may require a new attempt or manual action.
26. Refund method
Where technically possible, Koupely may return the amount through the payment method used for the original transaction.
For example: Wave purchase, Wave refund; Orange Money purchase, Orange Money refund; card payment, refund to the card associated with the transaction.
Some circumstances may require a different procedure.
27. Refund timing
The actual time it takes depends on the payment method, the provider, banks, telecom operators, payment networks, any necessary checks, and business days.
A "Refunded" status may reflect the moment Koupely or its provider carried out the operation, even though the amount actually appearing in the user's account may take an additional delay depending on that provider.
28. Delivery
Koupely may offer several delivery methods, for example home delivery, pickup at a relay point, or delivery by a partner.
The methods available depend on the product, the geographic area, the partner, stock, and logistical availability.
29. Delivery addresses
Users must provide an accurate address.
Koupely may allow users to save several addresses, set a default address, use geolocation, select a position on a map, use an autocomplete system, or add delivery instructions.
Users remain responsible for the accuracy of the information they provide.
30. Geolocation
With the user's permission, Koupely may use their device's location features to identify a position, make entering an address easier, calculate or prepare a delivery, show relay points, or help track a delivery.
Users may decline location access and use the alternative methods available, including manual entry.
31. Relay points
Where pickup at a relay point is available, the user may be asked to select their relay point before payment or order confirmation.
Relay points are set up and managed by Koupely or its partners. Their availability may vary.
32. Couriers and delivery partners
Koupely may use its own couriers or third-party partners.
Depending on the service offered, the user may see the courier's identity or first name, an estimated arrival time, delivery progress, an approximate or real-time location, and ways to communicate with them.
This information may change during delivery.
33. Pickup code and QR code
To secure the handover of an order, Koupely may generate a QR code, a numeric code, or a confirmation token.
Users must only share this code with the courier at the actual moment the order is handed over.
34. Single-use code
A delivery code or QR code may be valid only once.
Once validated, the order may be marked as delivered, the code may be automatically invalidated, and it may then be refused if used again.
Users must never share the code with anyone who is not actually handing them the order.
35. Order tracking
Koupely may show various stages, for example order confirmed, preparing, shipped, out for delivery, delivered, or cancelled.
This information is provided for operational tracking purposes and may be updated based on information received from partners.
36. Delivery estimates
The times or timeframes shown are generally estimates.
They may change due to traffic, weather, a logistics incident, a seller delay, a stock issue, an external event, or difficulty locating the recipient.
37. Recipient unavailable
Users must ensure that an authorized person can receive the order.
If no one is available, Koupely or the carrier may contact the user, reschedule the delivery, return the order, or apply additional fees where these were announced and agreed in advance.
38. Handing off to a third party
Users should only give a delivery code to a third party if they agree that person may receive the order on their behalf.
A handover validated with the correct code may be treated as an authorized handover, subject to the dispute mechanisms available.
39. Cancellation
Whether an order can be cancelled depends on its status, the type of product, preparation already under way, the seller, the offer's specific rules, and applicable regulations.
The cancellation options available are shown in the app where they exist.
40. Returns
Return terms may vary depending on the nature of the product, its condition, the seller, the country, the reason for return, and applicable legal provisions.
Some products or services may not be returnable where the law allows this.
41. Defective or non-conforming products
If a product received is clearly different from what was ordered, damaged, or defective, the user should contact Koupely or the relevant seller as soon as possible.
Evidence may be requested, such as photos, videos, the packaging, the order number, and a description of the issue.
42. Photos and descriptions
Koupely strives to present products accurately.
However, minor differences may exist due to screens, colors, product versions, or visuals supplied by sellers.
The essential characteristics shown on the product page remain the reference.
43. Favorites and recommendations
Koupely may allow users to save or be recommended certain offers.
Recommendations may be based on information such as categories browsed, usage history, preferences, or popular offers.
Where this personalization is optional, it can be turned off in the relevant settings.
44. Notifications
Koupely may send notifications about offers, price drops, orders, payments, refunds, deliveries, new drops, or account security, among other things.
Users can manage certain types of notifications from their device settings or Koupely's own settings where that option is available.
45. Sharing offers
Koupely may let users share an offer.
Sharing may increase an offer's visibility and, indirectly, the number of participants.
However, Koupely does not guarantee that sharing will necessarily lead to a new participant, a tier being reached, or a price drop.
46. Prohibited uses
Users may not, among other things, commit fraud, use payment cards or accounts without authorization, artificially manipulate the number of participants, create automated accounts, disrupt Koupely's servers, attempt to extract Koupely's data, bypass technical limitations, use unauthorized bots, exploit a security flaw, falsify a delivery code, or use Koupely for unlawful purposes.
47. Fraud
Koupely may use automated or manual fraud-prevention mechanisms.
A transaction may be suspended, reviewed, declined, or cancelled where a serious risk of fraud or abuse is detected.
48. Account suspension
Koupely may temporarily suspend or limit an account where reasonably necessary, in particular to protect the account, prevent fraud, comply with a legal obligation, investigate a transaction, or protect other users.
49. Account closure
Users may request that their account be deleted, subject to any orders in progress, refunds in progress, legal retention obligations, and any disputes.
Some data may need to be kept for as long as required by applicable legal or accounting obligations.
50. Service availability
Koupely strives to keep the service highly available.
However, the app may be temporarily unavailable for maintenance, updates, outages, network incidents, an issue at a provider, or security operations.
Koupely does not guarantee permanent, uninterrupted access.
51. Technical changes
Koupely may change its interface, add features, remove certain features, update its architecture, or change certain providers.
Such changes must not retroactively deprive users of rights arising from a transaction already validly concluded, subject to applicable rules.
52. Intellectual property
The Koupely brand, its name, visual identity, logo, interfaces, design, text, code, features and graphic elements are protected under applicable intellectual property rights.
Unless authorized, users may not reproduce, copy, modify, distribute, sell, or commercially exploit all or part of Koupely.
53. Third-party content
Some content may be supplied by sellers, partners, brands, or other providers.
That content remains the property of its respective owners.
54. Personal data
Using Koupely may require processing personal data.
The detailed rules on collecting, using, retaining, securing and exercising rights over this data are described in Koupely's Privacy Policy.
55. Security
Koupely implements technical and organizational measures designed to protect the service and its data against unauthorized access, destruction, alteration, or unauthorized disclosure, among other risks.
No IT system can be considered absolutely invulnerable, so Koupely cannot guarantee absolute security.
56. User responsibility
Users are responsible, among other things, for the information they provide, their credentials, their device, their use of the service, checking their order, sharing their delivery code, and the accuracy of their address.
57. Koupely's responsibility
Koupely is responsible for its own obligations within the limits set by applicable law.
Koupely cannot however be held liable for consequences resulting solely from misuse of the app, incorrect information provided by the user, an incident attributable to a telecom network, an independent payment provider, a force majeure event, or a fraudulent act by a third party reasonably beyond Koupely's control.
This clause does not limit any mandatory rights granted to consumers.
58. Force majeure
Koupely cannot be held liable for a failure resulting from an event beyond its reasonable control that it could not reasonably prevent.
This may include a natural disaster, war, civil unrest, a national telecommunications outage, a major disruption to financial systems, an administrative decision, a fire, or a major weather event.
59. Contact and customer service
For any question, complaint or request concerning an account, an offer, an order, a payment, a delivery or a refund, users can contact Koupely:

Requests relating to an order should, where possible, mention the relevant order number to help process them.
60. Complaints
Any complaint should include enough information to allow it to be processed, for example the order number, the date, a description of the issue, the payment method, and any useful screenshots or supporting documents.
Koupely will make reasonable efforts to handle the request within a reasonable time.
61. Electronic evidence
Electronic records kept by Koupely and its providers may be used to trace, among other things, a sign-in, an order, a confirmation, a payment, a refund, a delivery, or the use of a QR code.
They may serve as evidence to the extent admitted by applicable regulations.
